Terms of Service – Ferrio App

1. Introduction

These Terms of Service (the "Terms") govern the use of the Ferrio services (the "Services"), which include the ferrio.app website, the Android and iOS mobile applications, the Discord bot, and the related APIs.

The Services are provided by Andrzej Chmiel (the "Provider").

By using the Services, you agree to these Terms. If you do not agree, you must stop using the Services.

2. Description of the Services

Ferrio provides information about holidays, observances, and notable days for any day of the year. The same data is delivered through several front-ends:

  • • the ferrio.app website,
  • • the Android mobile app,
  • • the iOS mobile app,
  • • the Discord bot that exposes holiday commands on Discord servers,
  • • the public API hosted at api.ferrio.app.

The Services are provided free of charge. The Provider may add, change, limit, or discontinue any feature at any time without prior notice.

3. Eligibility

You may use the Services only if you can form a binding contract under the laws of your jurisdiction. Minors must use the Services under the supervision of a parent or legal guardian.

Use of the Discord bot is additionally subject to the Discord Terms of Service and Community Guidelines.

Use of the Android and iOS apps is additionally subject to the Google Play and App Store terms.

4. User Accounts

Some features of the mobile apps require signing in via Firebase Authentication. Anonymous sign-in is available but restricts access to features that require identification (such as submitting reports).

You are responsible for keeping your login credentials confidential and for any activity that occurs through your account.

The Discord bot does not require a separate Ferrio account; users are identified through their Discord account.

The ferrio.app website does not require registration.

5. User Content and Reports

Authenticated (non-anonymous) users may report errors in holiday information or suggest missing holidays ("User Content").

By submitting User Content, you:

  • • represent that you have the necessary rights to such content and that it does not infringe any third-party rights,
  • • grant the Provider a non-exclusive, royalty-free, worldwide, perpetual licence to use, review, and incorporate such content into the Ferrio database and to distribute it through any Ferrio front-end,
  • • acknowledge that the Provider is under no obligation to accept, publish, or retain the submitted content.

6. Acceptable Use

When using the Services, you agree not to:

  • • use them for any unlawful purpose or in a way that infringes the rights of others,
  • • spam, flood, or otherwise interfere with the operation of the Services, including the API,
  • • circumvent technical restrictions, rate limits, or authentication mechanisms,
  • • scrape data in bulk in order to rebuild a competing service,
  • • submit reports that are illegal, abusive, discriminatory, obscene, threatening, or otherwise inappropriate,
  • • impersonate any person or provide false information.

Violations may result in suspension or termination of your account or IP address without prior notice.

7. API Usage Limits

The public API may be used only in accordance with its published documentation and within reasonable usage limits. The Provider may introduce rate limits, block abusive clients, or require API keys in the future.

8. Intellectual Property

The Ferrio brand, logo, design, and source code are owned by the Provider or used under appropriate licences.

Holiday data is gathered from various public sources and user submissions and is provided for informational purposes only. You may use it for personal use and ordinary use of the Services. Commercial use requires the Provider's prior written consent.

9. Third-Party Services

The Services rely on third-party providers, including Firebase (Google LLC), Google Play, the Apple App Store, and Discord. The use of those parts of the Services is additionally subject to the terms and policies of those providers. The Provider is not responsible for the operation of any third-party service.

10. Personal Data

How personal data is processed is described in the Privacy Policy, which forms an integral part of these Terms.

11. Disclaimer

The Services are provided on an "as-is" and "as-available" basis, without warranties of any kind, including warranties of fitness for a particular purpose, uninterrupted availability, or accuracy and completeness of holiday data.

Holiday information is informational only and should not be used as the sole basis for legal, business, or official decisions.

12. Limitation of Liability

To the maximum extent permitted by law, the Provider shall not be liable for any indirect, incidental, consequential, or lost-profit damages arising from your use of or inability to use the Services, including errors in holiday data, downtime, loss of user data, or third-party service failures.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, towards consumers).

13. Suspension and Termination

You may stop using the Services at any time, uninstall the apps, remove the Discord bot from your server, or request account deletion in accordance with the Privacy Policy.

The Provider may suspend or terminate access to the Services, in whole or in part, in the event of a breach of these Terms, suspected abuse, or where required for technical, legal, or security reasons.

14. Changes to the Terms

The Provider may update these Terms at any time. The current version will always be available on ferrio.app and within the apps. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of Poland. Any disputes arising from the use of the Services shall be resolved by the competent Polish court. This does not deprive consumers of the protection granted to them by mandatory provisions of the law of their country of habitual residence.
